Terms of Service
The rules and expectations that govern your use of the Edtuition Platform.
Definitions
In these Terms of Service, the following terms have the meanings assigned to them:
- "Agreement" means these Terms of Service, together with our Privacy Policy and any other policies published on the Platform.
- "Content" means all text, images, videos, audio, assessments, past papers, lesson materials, AI-generated responses, and other materials made available through the Platform.
- "Edtuition", "Platform", "we", "us", or "our" refers to the Edtuition educational platform and Edtuition Tech (Pty) Ltd.
- "AI Tutor (Blobby)" means the artificial intelligence-powered tutoring assistant integrated into the Platform.
- "CAPS" means the Curriculum and Assessment Policy Statement, the national curriculum framework for South African schools.
- "User", "you", or "your" means any individual who accesses or uses the Platform, including learners, parents, and guardians.
- "Minor User" means a User who is under 18 years of age.
- "Subscription" means a paid plan granting access to premium features of the Platform.
- "User Content" means any content, data, or materials you submit to or generate on the Platform.
Acceptance of Terms
By registering for an account, accessing the Platform, or using any of its features, you confirm that:
- You have read and understood this Agreement in its entirety;
- You are at least 18 years of age, or, if you are a Minor User, that a parent or legal guardian has reviewed and accepted this Agreement on your behalf;
- If you are a parent or guardian accepting on behalf of a Minor User, you accept these Terms on behalf of that minor and assume full responsibility for their compliance;
- You have the legal capacity to enter into a binding agreement under South African law;
- You will comply with all applicable laws and regulations, including the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Protection of Personal Information Act 4 of 2013 (POPIA).
Eligibility & Account Registration
3.1 Eligibility
The Platform is designed for learners in Grades 8 to 12 in South Africa. Users outside this demographic may use the Platform for educational support purposes, subject to these Terms.
3.2 Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and update your account information as necessary;
- Keep your login credentials confidential and not share them with others;
- Notify us immediately at support@edtuition.co.za if you suspect unauthorised access to your account;
- Accept responsibility for all activity that occurs under your account.
3.3 Minor Users
If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf and consent to the collection and use of your personal information in accordance with our Privacy Policy.
Description of the Platform
Edtuition provides an AI-powered tutoring experience for South African high school learners. The Platform includes:
- Structured lessons and learning modules aligned to the CAPS curriculum (Grades 8–12);
- Past examination papers and worked solutions;
- Practice exercises, quizzes, and assessments;
- Personalised AI tutoring via the Blobby AI Tutor;
- Progress tracking, analytics, and performance insights;
- Subject-specific resources across core high school subjects.
We may update, modify, add, or remove features of the Platform at any time. We will endeavour to notify users of material changes in advance where reasonably practicable.
AI Tutor (Blobby) — Important Disclaimers
The Blobby AI Tutor is an artificial intelligence tool designed to assist with educational content. By using the AI Tutor, you acknowledge and agree that:
- Blobby is an AI tool, not a qualified human educator or professional tutor;
- AI-generated responses may occasionally contain errors, inaccuracies, or outdated information — always verify important answers against authoritative sources;
- Blobby's responses are intended to support learning and should not be relied upon as the sole basis for academic decisions;
- We do not guarantee specific academic results or improvements in grades from use of the AI Tutor;
- Conversations with Blobby may be reviewed by our team to improve the service, subject to our Privacy Policy;
- You must not attempt to manipulate, deceive, or misuse the AI Tutor for purposes outside of legitimate educational use.
Acceptable Use Policy
6.1 Permitted Use
You may use the Platform solely for legitimate educational purposes, in accordance with these Terms and all applicable laws.
6.2 Prohibited Conduct
You must not use the Platform to:
- Submit, upload, or distribute content that is unlawful, harmful, defamatory, obscene, offensive, or violates the rights of any third party;
- Cheat, commit academic dishonesty, or facilitate academic fraud;
- Impersonate any person or entity, or misrepresent your identity;
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure;
- Use automated tools, bots, scrapers, or scripts to access or extract data from the Platform without our prior written consent;
- Reverse engineer, decompile, or attempt to extract the source code of the Platform;
- Interfere with, disrupt, or damage the Platform or its servers;
- Upload or transmit malware, viruses, or any other harmful code;
- Use the Platform for any commercial purpose without our express written permission;
- Violate any applicable South African or international law or regulation.
Intellectual Property
7.1 Our Content
All Content on the Platform, including lesson materials, AI-generated content, software, trademarks, logos, and the Blobby character, is the exclusive property of Edtuition Tech (Pty) Ltd or its licensors. Nothing in these Terms grants you any ownership rights to our Content.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform's Content solely for your personal, non-commercial educational purposes.
7.2 Restrictions
You must not:
- Reproduce, distribute, publicly display, or create derivative works from our Content without our prior written consent;
- Remove or alter any copyright, trademark, or other proprietary notices on the Platform;
- Use our branding or Content in any manner that could mislead others.
7.3 User Content
You retain ownership of any User Content you submit to the Platform. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive licence to use, store, and display such content solely for the purposes of operating and improving the Platform.
Subscriptions & Payment
8.1 Free and Paid Features
Certain features of the Platform are available free of charge. Premium features require a paid Subscription. Details of current pricing and features are available on the Platform and are subject to change.
8.2 Payment Terms
By subscribing to a paid plan, you agree to pay all applicable fees in South African Rand (ZAR), provide accurate and complete payment information, and authorise us (or our payment processors) to charge your selected payment method for the applicable subscription fees.
8.3 Renewals and Cancellations
Subscriptions are billed on a recurring basis (monthly or annually, as selected). Your Subscription will automatically renew unless you cancel before the renewal date. You may cancel at any time through your account settings or by contacting support@edtuition.co.za.
8.4 Refund Policy
Refunds are considered on a case-by-case basis in accordance with the Consumer Protection Act 68 of 2008. Please contact support@edtuition.co.za within 7 days of a charge if you believe a refund is warranted.
Third-Party Services & Links
The Platform may contain links to third-party websites or integrate with third-party services (such as payment processors or authentication providers). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and is subject to those services' own terms.
Disclaimers
To the maximum extent permitted by applicable law:
Nothing in these Terms limits any rights you may have as a consumer under the Consumer Protection Act 68 of 2008 or any other mandatory applicable law.
Limitation of Liability
To the maximum extent permitted by South African law, in no event shall Edtuition Tech (Pty) Ltd, its directors, employees, agents, or partners be liable for:
- Any indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, goodwill, or other intangible losses;
- Damages arising from your use of or inability to use the Platform;
- Any errors or inaccuracies in Platform content, including AI-generated responses.
Our total aggregate liability to you for any claim arising from or related to the Platform shall not exceed the total amount paid by you (if any) to us in the 3 months preceding the event giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Edtuition Tech (Pty) Ltd and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of or access to the Platform;
- Your violation of these Terms;
- Your User Content;
- Your violation of any third-party rights or applicable law.
Termination
13.1 Termination by You
You may close your account and stop using the Platform at any time by using the account deletion feature in your Edtuition Platform settings.
13.2 Termination by Us
We reserve the right to suspend or permanently terminate your access to the Platform, with or without notice, if you breach any provision of these Terms, we are required to do so by law, or we decide to discontinue the Platform or a material feature thereof.
13.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply, including Sections 7, 10, 11, 12, and 15.
Modifications to These Terms
We may update these Terms from time to time to reflect changes in our services, technology, law, or business. When we make material changes, we will post the updated Terms on the Platform with a revised effective date, and where practicable, notify registered users by email or in-app notification.
Governing Law & Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
15.2 Dispute Resolution
In the event of a dispute arising from or relating to these Terms or the Platform, the parties agree to first attempt to resolve the matter amicably through good-faith negotiations. If the dispute is not resolved within 30 days of written notice, it shall be submitted to the jurisdiction of the courts of South Africa.
15.3 Consumer Complaints
If you have an unresolved complaint, you may contact the National Consumer Commission (NCC) at www.thencc.org.za or the Consumer Goods and Services Ombud (CGSO) if applicable.
General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Edtuition regarding the Platform and supersede all prior agreements.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right.
- Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to any affiliate or successor entity.
- Force Majeure: We will not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including load-shedding, internet outages, natural disasters, or acts of government.
- Language: These Terms are written in English. In the event of any inconsistency between an English version and any translation, the English version shall prevail.
